I too believe initial terms were agreed for M&G some time ago however it appears the delays in final release may work well for us as we can now potentially add substantial quality to the entire unit. In a conversation with Geoff mid 15 he felt that if the device was released prior to Xmas 15 we would be unlikely to be included but the longer it went into 2016 then the probability for our inclusion increased dramatically. From the cautious but confident words in the 4C it would seem that we are well placed.
On any basis, I am supporting a vote of #3 and as a holder since SSH days have always seen this as a Dolby scenario - clipping a ticket after many million of clipping tickets into the future.
As for an upfront, a minimum of our agreed participant costs plus an internal cashflow pillow of $5M.
