If something like this is the situation
(1) Big problem with regulatory approval - months and $$$ to fix
then some investors already know and have known for a while now, while the rest of us are in the dark. The company is obliged to tell all shareholders what the problem is. They can refine that information as they analyse it but they must release an ann immediately under continuous disclosure.
