Kavanaugh has voted against Trump on odd issues. None the less he has long been considered partisan and has always had some ethic complaings floating around. He is strong on the issue of Presidential immunity from criminal prosecution.
Reputation and good standing was one of George Washington's SCOTUS appointment criterions. Reputation is not simply about a lack of criminal convictions. Kavenaiugh gets a fail on this whether anyone likes it or not.
Kavenaugh is strong on the separation of powers issue and cannot therefore be relied on by Trump to nullify postal votes in the absense of any evidence of massive fraud. If such evidence were to be found there is no follow-on assumption that either a progressive or conservative SCOTUS would then allow Trump to hold power, particularly if there is evidence of voter line intimidation.
Should Barrett or Lagoa be formally nominated we should see what Biden says before going further on this.
