I agree, that because the reporting of PEople Tels figures were supposed to indicate the size of the agreement, and so affect the share price, it was a material breach.
However, I got the feeling that Adrian Reading of ASIC wasn't that interested ( fair enough - its a boring and repititive job!) ..hadn't really looked at it and was just a foruma response. He kept saying "no material breach" yet could not seem to recall any of the detail of what the complaint was about.
Anyway - poor ol rene rivkin must accutely sense how he is a scapegoat to make it seem like there is actually some sort of regualation out there, to the naive public.
