Hey Roon, it was pleasantly surprising how quickly the ICC MMCS case was heard & decided upon earlier in the year - pretty sure the ruling was made & publicised within weeks. Whether we get a Jin Cheng no-show or an AVZ victory at arbitration this week, the combined Zijin/Cominiere damages claim disappears.
Correct me if I’m wrong, but the only other case left at ICC involving Cominiere would be AVZ’s request to affirm its 75% interest in the Dathcom JVA. This is where Cominiere (as a minor shareholder) had announced that it had terminated the joint venture & helped itself to AVZ’s 75%, & AVZ wanted ICC to set them straight. I don’t know about your take on this, but this case seems as open & shut in favour of AVZ as the Dathomir 15% seller’s remorse case - AVZ have done all the work & spent all the coin on advancing Manono, the initial ICC hearing awarded partial court costs to AVZ & imposed fines on Cominiere if they even hinted on the JVA being dissolved, AVZ have the backing of the DRC’s very own corporate watchdog (Jules Alingete of the IGF), & Cominiere don’t have 2 coins to rub together to attend & defend at ICC.
I’m not saying this is how things WILL pan out, but if it does, I’d lean towards us getting back on track sooner than most are expecting. That’s so long as the snakes don’t have yet another dodgy ace up their sleeve.
