I think if you look at what % of the amount the two individuals made the percentage is far higher.
The two individuals would be the same as Barnes and Grimaldi in this case who have breached their duties it is claimed.
CHM in their case would be looking for an accounting of their profit which given Grimaldi had a $37 million tax bill gives some idea what was made.
This part and potential win is outside scope of MMX claim and is an additional source of cash depending on the individuals financial position if CHM win.
Where the case is different is that it is claimed the two indivduals provided a benefit to a company in this case MMX
The plaintiffs in the other case never accused the company itself of misuse of its funds.
In CHM case they claim Nicu had knowledge and therefore willing gained a benefit.
This opens open the direct interest in asset claim which was not available in the case.
