Whenever I look at the confectionery section in Big W, Reject...

Whenever I look at the confectionery section in Big W, Reject Shop or whatever, Yowie's are either sold out or selling quick, and Kinders are always full - and I don't think this is because Kinder are selling fast and are being restocked. Maybe Yowie just resonates with Australian consumers more because of its history but I think Yowie has a much better brand than Kinder Suprise/Joy/whatever (save the natural world) and product (endangered species scale models). All that to say that based on what I've seen in Australian shops there is definitely room for both in the market and Yowie should do fine in competition with Kinder regardless of the patent.
