2. if I have managed to find the right document and my legalese is somewhere near useful, per clause 6(4) of http://www.mining.go.ke/index.php/r...4-mining-state-participation-regulations-2017 ... "...The State's right to a free carried interest shall not apply to any right that has been granted to a holder of a mining licence, to mine a mineral before the coming into force of the Act...."
