Great post Vlad on the rationale for Stone's case.
Would appreciate your comments on the outcome Stone is seeking if their case is successful, particularly the vestment to ASIC of any convertible note shares issued so they can be subsequently sold.
From my reading such a ruling is clearly beyond the jurisdiction of the Takeovers Panel to make, so why make such a request?
Me thinks the Stone legal advisors at the last moment realized that if they were successful, FML could call in the $13 million owed to it by CRE, and as such there was a need to try and come up with something to negate this.
