I believe Cougar had "trigger" values as defined by the Autralian Drinking Water Standard ... in this case 1 ppb of benzene ... which just happens to be pretty much the lowest value that can be detected by the laboratory methods used.
A "trigger" value is one which if exceeded warrants further investigation ... in Cougar's case they clearly did.
And yes, one further transient reading of 2 ppb was detected ... which happens to be mutiples below other accepted global drinking water standards.
In no way can exceeding a "trigger" value be constued as contamination ... for DERM to interpret it that was is unscientific and for DERM to choose to interpret it that way is at best, misleading.
Imo, it simply will not stand up in any legal proceedings, especially when multiple high ranking politicians and regulators and press are on record as saying 10 to 100 times higher in CSG process water dams is harmless ... guess what, water in CSG process water dams has in most instances been extracted from groundwater at the site.
But I hear you about some regulators wanting (wishing?) they could "hide" behind regulations without having to consider any the underlying science.
