It's not uncommon for builders of such things to be offered a protection period during which they are able to recoup their investment.
IIRC the intention was that a new "wholesale" network be built open to all retailers to offer services on.
Telstra themselves have said that if the price is right it may be more economical for them to use the new network to offer services in some areas.
