The final rules surrounding the 30D new energy vehicle consumer tax credit in the Inflation Reduction Act have been released along with DoE guidance on the interpretation of what a Foreign Entity of Concern is. The graphite in battery anodes has been defined as "impracticable-to-trace" meaning it is exempted from the due diligence and FEOC requirements until 2027.
This exemption highlights the dominance of China in the graphite anode supply chain. The country is forecast to account for 72% of natural graphite supply this year and 77% of synthetic graphite.
