Breaking down from a base isn't where you see capitulation, that happens after the trend has exhausted itself. This is just the beginning of the new leg down.
As for the funnymentals and courts and blah blah, the market knows all this and they're selling it. Maybe one day your funnymentals will prove to be correct or maybe one day you'll find out you were wrong .... one of my favourite market quotes is from Druckenmiller "I'm wrong far too often to rely on being right to make money"
