I was wondering if anybody has filled their form in yet, and what proof they have of misrepresentation. With Sons of Gwalia it was very specific - failed to notify the ASX that its gold reserves were insufficient to meet its gold delivery contracts.
We can argue for damages on the grounds that the company had breached its continuous disclosure obligations and, by reason of the non-disclosure, had engaged in misleading and deceptive conduct. However, we will have to be specific.
