Considering the 7/09 agreement it seems D&C believe the shootout agreement includes for a bargining process otherwise they would have simply matched the original bid and bought out SRK.
Also if SRKs original bid is serious and final it suggests that SRKs 50% holding is largely worthless. I hope this is not the case because it would then suggest that their investment into Cuervo, a similar company, is also largely worthless.
