Just musing aloud about what teh MInister may decide, but I was thinking this morning: what if the Minister allows the appeal giving the residents a win, but then, based on the further investigations recently undertaken, makes an order issuing the TOL himself.
It seems to be an option legally open to him under the Act. It would also have some advantages - it gives the residents a bit of a boost, makinmg them feel their voices have been heard. It makes the Minister look careful and thorough fully investigating the issues. More importantly, it makes the decision completely unapellable.
