The judge was in the process of delivering his judgement and, in my opinion, he was clearly leaning towards granting costs to the applicant ( Leydin) Since, if I understood correctly, Pursell was a respondent and may have been on the hook personally for a portion of the costs, I believe he quickly gave that instruction so it didn't cost him anything. That is how I saw it
