When they're using the court system it's hard to believe it can be abused to that degree. They're not using emergency state powers to bypass the law so need to comply or the other party can oppose the abuse in the same courts.
The only advantage the banks might have is in the contract they used which they were obliged to explain to the mortgagor so they should be aware of that. Also the ability of the banks to fight in court with unlimited funds.
