What concerns me, is that IMO the Court will not be looking at what the previous NXS Directors have or have not been doing while in control of NXS.

All it will be looking at, is if the deal has been made according to the laws and where all the parties have been treated fairly and according to the Laws.

It would be a different kettle of fish altogether if the Court Case was revolving around the Company's Directors and their doings but, unfortunately it is not.

Nevertheless, and IMHO I believe that the Judge will be looking at all facts that have been put in front of him and, hopefully, he will be looking at it all, AND US SHAREHOLDERS, with a sympathetic eye.
