Correct, the most recent patent claim has been withdrawn. The other, older one has been going for 18 months, the first set of lawyers jumped ship. This was rumoured to be because they felt they were leaving themselves open to a charge of prosecuting a case without merit. Nestor have now retained another set of lawyers. Redflex have repeatedly said they believe this original case does not have any merit. Nestor in their previous life as a neural technology company had a history of patent action against competitors, mostly unsuccessful cases, it really is pretty standard operating procedure so as to try to hog tie a more successful competitor.
Still cannot completely rule out the possibility that Nestor will win but the second (dismissed) patent action was supposed to shore up the chances of the original action which possibly says something.
