Your argument makes little sense, what @joulesmm1 stated is correct:
"BRN does not have a product in commercial sale and while its not at-market or in-market or in a market
it may well be marketable and market ready"
This is clearly what BRN are claiming in their announcement and there is nothing ambiguous about it in their wording
