When I looked into the issue, it seemed very grey. The following were taken into account when determining whether you are a trader / investor
- intent
- frequency, volume, and value of trades
- account keeping systems

Dtermination is by the ATO. You cant just pick what suits you. I don't know where they draw a line in the sand. I've never been clear on what happens if you are in one category for several yrs and then change investment style.

Agree with Bellenuit re seperate legal entities being safest.
