Yes, huge mixed messages this morning prior to ann. Just guessing, because I was thinking along two lines, serious investors don't like problems being resolved in long drawn out Court actions and were selling, or, the leaks were back and it wasn't looking good.
But, iomtt, your point regarding instos is also very interesting. The wording of the ann just confirms that without inside knowledge, this is a clear cut toss of the coin situation and it is not unreasonable to think that larger SHs would not be punting straight out and having an each way bet instead, just in case. That is prudent investing for larger holders by just hedging their bets either way.

But, very understandable for "concerns" to be raised when all the trading pre ann was heavy selling.
Can only hope that it was just "prudent" and not "knowledgeable", investors.
