If the company is informed prior to the public there would need to be a trading halt irrespective of whether the decision is positive or negative. Why would you presume that a positive decision would have no material effect on the share price but a negative decision would? The market has already priced in a decent probability of a negative decision, so anything which removes that uncertainty would undoubtedly have a significant positive ipact...
