I have a pessimistic view for Lynas into 2013. The best case scenario will be for the TOL stay to be lifted this week; the inevitable appeal to the federal judiciary not effect the TOL; then for production to begin immediately with sales down the track to a newly resurgent market.

Any one of the above doesn't occur and won't capital raising need to occur?

I think it's likely that the judicial process continues well beyond this week, regardless of the decision, and that when Lynas eventually begins production that they will be selling to a smaller market at a lower price.
