One also needs to assess the consequences of this opportunistic play on ISX. You are correct that most of the winnings (if successful) will go to the litigation funders, but there is also the reputational damage to the Isignthis brand. Additionally, there are indirect damages to the board members and so on. As current shareholders, do we want this?
One thing is certain in my view: ISX was suspended primarily due to suspicions that performance shares were illegally obtained. However, that motion was defeated in court. Shareholders prior to suspension did well, so why would they file a class action, for what? The class action should be on ASX, not ISX.
