I'm not sure about their patent protection. I couldn't find much info on patent applications and status. If it is not registrable, its all over.

However neither of the key 2 players in this guys are clueless, they come with extensive experience in the field so I can't imagine them being caught out on patent issue.
Still, it is a risk which was cited in the AEB prospectus, it is probably standard wording when you don't hold the patent outright at the point of publication.

I don't think we should underestimate Australian inventiveness, and collaborative strengths with the land of innovators, America. Equally I am not fazed by the too good to be true cautions.
