Trump has been
found guilty of 34 E-Class felonies (considered the lowest level of felony offences in the state of New York), namely falsifying business records in the first degree which states, “A person is guilty of falsifying business records in the first degree when he commits the crime of falsifying business records in the second degree, and when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof.”
So what was the crime he was apparently going to commit, or aid or conceal the commission thereof???
Surely in order to convict a person of these charges it would have to be established beyond reasonable doubt that the secondary crime was indeed intended to be committed, or aided or concealed.
So what crime was it??? Can any of the LWNJs here tell me??
Because without that being established and published by the Court, how can the convictions stand???
This case will be destroyed on appeal, maybe not in New York but ultimately a federal court.
The judge instructed the Jury incorrectly imo and again this will fail on appeal.
