    First Amendment and absolutely would be covered by free speech...without a doubt.

    And like here, that FITH 18C... that daft law on discrimination which puts the onus on the person hearing or seeing something and whether they take offense regardless of the intent of the other person...when you say "aggravating" a judge...that depends on the judge, his level of sensitivity and the thickness of his skin and not the act of say rolling ones eyes or staring. With another judge, that might not aggravate them one tiny bit.

    Now you may not do yourself any favors and listening to someone the other night, juries tend to bond with the judge and showing that sort of thing may degrade your impact on them if the judge gets all gnarly about it...but it aint against the law.
