It really doesn't matter since both sides at some point thought that was acceptable to them both. Xstrata simply turns up at some point with that deal. What Xstrata have lost is exclusivity. But in their judgement obviously they do not see any imminent threat, or are ready if Anglo move (good news for us), or both.

NKP are hardly likely to turn an offer down, they may try and dicker, but hard to do so without some tangible base of argument, plus time..not NKP's friend.

So the lapsed option, still hangs in the ether.
