It depends what is in the Binding Contract - say there is a clause saying the party must deliver xxxxx by a certain date. If it is not delivered by that date then the other party can walk away from the agreement regardless of what the other party wants to do. Without seeing the specifics of the contract it is difficult to comment here.

The only reason that I think Divan is still happening is I would expect that if a walk away did occur that TV2 would have to immediately inform the market of that outcome given it has been sold to SH as a binding agreement. If Hollywood has fallen through they should not be hiding under the fact that K2U has been delivered so the agreement remains binding if you know what I mean - there were two elements to the binding agreement IMO been K2U and Hollywood.

The earlier in the week an update is released the better - needs to put all this speculation to bed so that potential, new and old investors can make effective decisions.
