The thing is that at the time, it was crystal-clear that there was no 'offence'. Had ASIC been paying attention, or been even-handed, they would never have embarked on the futile $10m + exercise.
When the unbalanced Financial Review article came out, engineered by the Chinese, ASIC fell for it hook, line, and sinker.
I clearly remember being totally amazed at the Fin Review article when it was released. It just did not reflect reality.
