unforeseen yes but only because it was a failure of proper testing and commissioning before roll out. and we've already discussed the fact that contractual limitations aren't bulletproof. i agree with you that compensation of some sort is inevitable, whether via legal means or ex gratia.
to say that there are no legal ramifications as an absolute, is just silly and with mindset, can land people in hot water when investing in shares.
