Could you expand on why you think that way? What conduct on the part of the directors do you think was negligent?
As I've said before, the mere fact of an outage will not get you negligence on its own. Sure, if the Board Risk Committee were provided with a CRO's report every month saying the likelihood of a significant outage that would last for weeks was very high and they sat on it and did absolutely nothing, then maybe there's some prospect of a finding of negligence, but there's no indication whatsoever that anything like that has happened. And I don't think that's particularly likely for a Board of this calibre (David Thodey, David Fite, Catherine Harris AO, etc).
So what exactly is it that you think will found a claim in negligence?
