It would only be breaking confidentiality,if they named the company.If they have been approached or they have approached (one) company and it has been said,do not let on this is happening,yes in that case.
If there is more than one company involved in talks I don't feel that would be breaking confidentiality terms,in saying yes we are in talk.As long as they do not name them.

As I have said before BRM have been announcing these talks since they were in talks with a few,they have 24 at last count.
Sundance have at least 12,and have named ArcelorMittal,Tata,Posco and The Chinese.
