but, if i was trying to be non biased for you.....if it settles late, it is up to each individual contract as to whether penalties are applicable.... We have heard no mention of penalties, and if significant, we would legally be required to hear about them. Therefore, I am comfortable there are no penalties for late settlement (or at least not material).
If there was no subject to finance clause then usually the vendor could sue the purchaser, but, likely for loss/compensation. I.e. The practical thing would be that if Indue still want a sale, would advertise it on the market, then sue stargroup for any shortfall, less profits made over time etc... Based on the profits and business....not likely in the slightest.
So, most likely case, the deal wouldn't go through, Indue either sells for same price or chooses not to sell in the end... They could probably get back lost money on legals etc from star group... But, it is STL that has spent the time, money and effort on legals and due diligence as opposed to Indue.....
But, I am steadfast that I believe it will go through.... just a delay.
