IXC needs to be proactive and release a statement. It was well aware of the claims made, released such information in the prospectus (and still had a hugely successful IPO), and would have done their due diligence before entering into any agreements with the University. They have acted appropriately. And if they believe the claims are baseless, then I'm inclined to trust them.

I agree with @Mpk888 that this is a money grab from a small company. They know the drug will be successful and want a cut of the University's profits. I say University because I strongly suspect that if the lawsuit is upheld, IXC can seek damages from the University.
