IF a claim is established, and pursued AND proven Exelgens claim is limited to damages against the university as IXC have not been joined as aprty. If you are saying that Exelgen are pursuing IXC you be very clear on your sources because if untrue the company (if they have the inclination) can pursue third parties who have published (via HC) unfounded opinions that may have resulted in loss or damage to IXC.

There is no contractual agreement between IXC and Exelgens. There is a license agreement between the university and IXC. Common provisions in these license's include a indemnity against damages resulting from the negligence of the other party. A failure by the university to ensure they are legally entitled to commercially exploit IP means the university is liable, not IXC.

IF an injunction is sought against IXC by Exelgen than than IXC will immediately join the university and seek an indemnity of whatever Exelgen claim.

NOW... this is the fun bit, IF the FDA approval is received AND IXC get the research to a point where it is approved for market and Exelgen are successful in stopping the product from being commercialized due to IP infringement (and yes they will wait until research is done to see how much money they can get), IXC will immediately pursue the university for whatever loss or damage that is the result of the universities negligence.
