I read some research recently that said these things;

1. Court of Appeal hearing begins 29th October 2012.
2. Expected to be over by Christmas (worst case: April 2013).
3. The case can be taken to the Supreme Court beyond the Court of Appeal hearing (and in fact BTU can elect to go straight there if they wish).
4. The West Coast Environmental Network is funded by individuals, and their loss means that they will incur BTU's costs.

So I am not sure that any of the trading has anything to do with the legal proceedings (except, of course, for the long-term downward trend).

Then again, maybe someone knows something that I don't about the 'national significance' angle! ;)
