Don't think they can be sued, Zip doesn't have a trademark in the US. I think it's a strategic move by Sezzle to impede any future move into the US by Zip. It worked for Klarna/Afterpay.NL over in the UK in slowing down Afterpay.
I am sure Sezzle would be happy to sell itself to Zip at the right price also.
