Hi Buddy - interesting to say the least. Apache (if it's the same one) were involved with Nexus back in 2005 with Longtom drilling. They had the option to buy into Longtom, but did not take up the option.
Hard to comment on the legal side in US, but this was (is) most likely a back up for Nexus deal.
Whilst the DOCA has been prepared, there is still some way to go as it needs ASIC and Federal Court approval. Let's just say NBT won't be sitting around idly waiting for that to happen!
