Pure speculation on my part, but you would think that a financier lending someone the first $20m would impose some conditions on how that money is spent.
My guess therefore is that they would have asked for the first $20 mil back, but as I say, it doesn't seem clear from the announcement whether that is the case, or whether Novaquest are simply withholding Stage 2 funding.
