Al , I dont think your claims stack up re MCC. if it were as clear cut as that it would have been dealt with by now. For a start the Supreme court has ruled in favour of MCC that the spirit of the contract was that any disagreements were to go to arbitration, so they would argue that CFE was heavy handed in taking it to court. of course contracts will be written differently next time, but not because of the chinese, CFE just made a bad contract and stuffed it up, like they did their tax. I have heard so many different versions of what the contract stated, apparently from CFE, that I am still none the wiser. An article in the paper recently by a court reporter stated that CFE were supposed to provide mining licenses which did not happen. Was that CFE fault or not , I dont know and I dont think anyone else here really knows either. lets see what happens in arbitration.
