From what I have read it seems that the original agreement had a clause in it that should there be any disputes it may then be referred to a dispute negotiation process and not directly to a court. This latest announcement I believe says that the WA Supreme Court has gone back on their original decision for the money to be paid into escrow and made an order that it go back to arbitration.

I wish we were as ruthless as the Chinese in business but I guess we cannot be because we haven't got the cash, they have.
One thing that is very positive in all this is that the WA Supreme Court nor anyone else has dismissed CFE's claim as invalid. The issue is being resolved slowly accounting for all the red tape and process issues on the way, that is very slowly.
