So this tells me that both parties did not agree on the appointment of the expert and now the court must decide. Still not sure if Her Honour will extend the deadline to accommodate the full 28 days, which will put it past the 45 days on Oct 30. If (as we expect) the MinRes claim is frivolous then the deadline might not be extended.
Is there a way that we can have this contract torn up and MIN get nothing at all ?
