there is a legal concept know as "void ab initio" which essentially means void from its inception. If the Court were to find the TOL issue was void ab initio, it would be treated as a legal nullity ie as if it never occurred. I reiterate that I think it unlikely that a Court would make such a finding. Nonethless, I disagree with you that the fact that the TOL was issued in September means the MK conversion issue is no longer relevant.
