I agree with you Kiril,

As I recall, there were a number of posts on HC in the months and weeks leading up to the expiration date of those options which showed written confirmation by management ( in reply to emailed questions from shareholders / HC members ) that they would definitely ensure option holders are looked after in the event of those options finishing out of the money ... the line from management at the time was that this was most unlikely to be the case, as they were confident of a share price re-rating before expiry date ( expecting good news on the BFS / JV front, I believe ... retrospective LOL ! ).

Can't remember the exact wording they used now, but I do remember comments being made on HC which indicated that management would now be open to litigation if they didn't make good on their pledges ... In fact on the strength of those pledges, I believe many people ( including yourself and me ) either bought more options cheaply just before expiry, or decided to hang on to what they had rather than sell while they were still worth something.

If Nkwe fails to come good on this, then as you say, I'm sure there would be a lot of support for a class action at some point ... However, as to when that would be appropriate, I'm not so certain ... After all, we all probably would like them to be able to concentrate on securing us as good a deal as possible in the current negotiations, rather than handling another legal challenge.

Will be most interesting to see how it all pans out in the end ... but the matter has definitely not been forgotten !
