EPA stuff?

Lewis, if you take a look at the EPA website on the appeals convenor https://www.appealsconvenor.wa.gov.au/What-to-expect/When-an-appeal-is-being-investigated
You’ll note :

..”The Minister is required to take the Appeals Convenor's report into account before deciding the appeal.
The Minister can generally allow an appeal (in full or in part), or dismiss an appeal. ​

In the case of appeals against a decision or recommendation of the Environmental Protection Authority, the outcomes available may include remitting the proposal to the Authority for fresh assessment or varying the conditions recommended by the Authority…”​

In cases where the appellant wants the EPA to vary the conditions, I assume it’s often the entity which submitted the document that appealed …. Despite that some here seem to think such an idea is outlandish.

How long does the appeal process take?​

While there are no statutory timelines in respect to appeal investigations, the Appeals Convenor aims to have 80% of appeal reports submitted to the Minister for Environment within 60 days of receiving a final response to the appeal from the relevant decision-making authority and proponent​

- Seeing as back in the quarterly report of 30 June, 24*, AVL wrote it had done it’s bit in relation to the appeal, and it was in the hands of the OAC [ref] (*now 14.5 weeks ago), I hope we might hear soon as to what conclusion was arrived at by the ‘decision-makers’ and Minister.
