VCR would not have launched this action without being very confident on its IPM position - they are happy for a jury to decide on the IP. There are substantial penalties in the US for frivolous actions and VCR is very aware of these.
HeartWare has 20 days to respond and VCR expects a hearing within 6 months.
The IDE submission will occur this year ( I hear end of year bonuses are tied to it)
