VCR's design is way better than HTW's. No moving parts other than the rotor which is magnetically suspended. I believe HTW's is a transaxial device with some mechanical contacts which will eventually wear out. The only advantage of HTW's is its smaller size.
Also VCR is at least a couple of years ahead in terms of clinical trials.
About the patent infringement settlement, I think that was the right thing to do. It would have been hard and costly to pursue to a court trial since HTW's design had at the time already been granted a US patent. That is the US patent office had already considered HTW's design to be novel and did not fall on the patent claims of VCR.
